Mediation Services

Attorneys Bill Mann and Bill Dulaney are available to provide dispute mediation services.

They have found that parties to litigation or parties who have a legal dispute are often better served by mediation than by protracted litigation and/or by a trial, and perhaps subsequent appeal.

Bill and Bill have found that many parties have a mutuality of interests that they simply fail to recognize for one or a variety of reasons, and that these mutual interests can often lead to a successful, fair resolution of the case or dispute.

When acting as Mediators, Bill Mann and Bill Dulaney strive to:

• Treat everybody with dignity and respect
• Lower the emotional temperature of the parties (and sometimes the lawyers)
• Listen carefully to what everybody has to say
• Identify the facts and law in each case that one or all the parties may wish to re­ examine in their own best interests
• Diplomatically and fairly prod, urge and respectfully request that the parties focus on the strengths and weaknesses of their own case, and revise and amend their positions regarding settlement accordingly
• Be patient and persistent
• Respectfully remind the parties that a settlement is “a sure thing now,” while litigation always involves the risk of losing or not doing as well as a party may have hoped, and that litigation is almost always more expensive than litigation as well, as indicated, of being much riskier and time consuming.

Bill Mann has dozens of years of litigation experience and has mediated well over an estimated 200 cases. Bill Mann has an extensive background in civil litigation, having worked as a Judicial Law Clerk at the Court of Common Pleas, the Court of Appeals of Ohio, and the Supreme Court of Ohio has litigated cases throughout Ohio, and has tried cases to jury verdict throughout Ohio and in the Federal District Court for the Western District of Pennsylvania. Most of the cases Bill Mann has litigated have involved medical issues. Bill Dulaney has been an arbitrator with the American Arbitration Association for over 30 years. He has sat as arbitrator on dozens of complex commercial and construction cases in that time. In addition, Bill Dulaney has a degree in engineering, and and MBA and these qualifications can be especially valuable cases involving technical and/or business issues. He has been hired as a private mediator by parties seeking resolution in a case that needed third party intervention by a knowledgeable facilitator.
